Como sostiene Manuel Atienza, quiz\u00e1s el m\u00e1ximo exponente de la teor\u00eda de la argumentaci\u00f3n jur\u00eddica en Argentina y el mundo hispanohablante: \u00abel Derecho es, esencialmente, una t\u00e9cnica para resolver conflictos mediante argumentos\u00bb [Atienza, M.,\u00a0<em>Las razones del Derecho<\/em>, 2005, p. 12].<\/p>\n<p>Esta perspectiva implica un giro copernicano: el objeto de estudio del jurista ya no son solo las normas (el \u00abser\u00bb del Derecho), sino las razones y los procedimientos mediante los cuales esas normas se interpretan, aplican y se justifican sus decisiones. En el sistema adversarial estadounidense, esta dimensi\u00f3n argumentativa alcanza su m\u00e1xima expresi\u00f3n, mientras que en el sistema romano-germ\u00e1nico, como el argentino, se manifiesta de manera particular en la fundamentaci\u00f3n de las sentencias y en los escritos de las partes.<\/p>\n<p>Objetivos del Programa:<\/p>\n<p>\u00b7 Dominar las dimensiones argumentativas: Conocer y aplicar las perspectivas formal (silogismo), material (justificaci\u00f3n de fondo) y pragm\u00e1tica (persuasi\u00f3n y comunicaci\u00f3n) de la argumentaci\u00f3n .<br \/>\n\u00b7 Identificar tipos de argumentos jur\u00eddicos: Diferenciar y usar correctamente argumentos interpretativos, anal\u00f3gicos, dogm\u00e1ticos, basados en precedentes y emp\u00edricos seg\u00fan cada caso .<br \/>\n\u00b7 Aplicar m\u00e9todos de interpretaci\u00f3n: Conocer y manejar los criterios y m\u00e9todos de interpretaci\u00f3n jur\u00eddica para resolver problemas de relevancia, calificaci\u00f3n jur\u00eddica o lagunas normativas .<br \/>\n\u00b7 Analizar casos dif\u00edciles y falacias: Evaluar casos complejos distingui\u00e9ndolos de los f\u00e1ciles, y detectar malos argumentos o falacias
